21) Change or cancellation of departure. Deviation. The timetable for departure and arrival has a mere indicative value and the Carrier has the right to anticipate or postpone the departure of the vessel and in such case the Passenger shall not be allowed to claim for any damage. In case the departure is postponed for more than 24 hours the Passenger can ask the rescission of the contract and claim back the advanced freight only also in case of cancellation of departure the passenger shall be allowed to claim back the advanced freight only. The Carrier, the Master have the right to call other ports, different from the original ones, due to navigation needs. The Carrier shall bear no liability for loss or damage due to storms, shipwreck, collision, deviation, quarantene, fire, acts of war, piracy and any other accident or peril of the sea, postponement or cancellation of calls, change of route and timetable and any other event concerning the navigation due force majeur and due to strikes of maritime and/or land staff. In case the Carrier cancel a departure, and/or cancel a calI, change the port of departure, anticipate ot postpone the date of departure the Passenger who is not willing to perform the voyage has the right to claim back the advanced freight only and in no case he shall be allowed to claim for damages or costs of any kind. The Passenger shall not be entitled to any claim for damages or costs in case of anticipated or postponed arrival of the vessel.
21 bis)The company does not accept responsibility for cancellation of crossings owing to bad weather.
22) Arrangement on board. In case of any mistake in the arrangement no damage can be claimed by Passenger, who shall accept the best possible arrangement available.
23) Liability for carriage of vehicles. The Carrier has no liability for loss or damage occurred to vehicles during loading and discharging operations. The driving passenger is liable towards the Carrier and third parties for any damages caused by his vehicle both during loading and discharging operations and during the sea passage. The Carrier is not liable for loss or damage to objects inside the vehicle. Any valuable object, cameras, binoculars, etc... can be delivered to the Staff on board who shall issue proper receipt.
24) Valuable objects. The Carrier is not liable for theft, loss or damage suffered by valuable objects, money, documents, papers, placed into the luggage, into the cabin or into the vehicle, unless the same had been delivered to Staff.
25) Lien and right of retention. The Carrier has a lien and a right of retention on luggage and other Passengers' belongings, including the vehicle, as a guarantee for any payment due by the Passenger to the Carrier for any cause because of acts or facts relating to the carriage. Consequently, if the Passenger does not pay the due amounts, the Carrier shall have the right to sell the above mentioned goods, even without Court order, and use the amount earned to pay the principal, interests and accessories.
26) Claims. Claims of any kind shall be immediately notified to the Staff by the Passenger. Claim for damages to vehicles shall be immediately notified to Staff which will draw a survey report on behalf of the Passenger. The Passenger shall sign the report, which is issued without prejudice nor admission of liability by the Carrier. Letter of claim without copy of the survey report shall not be examined by the Carrier. Apart from any time-bar more favourable to the Carrier provided by the applicable law, any right and action against the Carrier, in contract or in tort, for death or injuries, for loss or damage to luggage or vehicle, or for damages of any kind shall be considered as time barred unless a writ of summon be lawfully served before the competent court within one year from disembark of the Passenger. In no case the Carrier shall be liable for any act or fact happened out of the vessel.
